Hi. I am an Educational Psychologist specializing in vocational return to work counseling for injured workers and we have the finger on the pulse in these matters. It is my opinion that insurance adjusters are not issuing the vouchers that trigger the $5K RTWSP. There is a huge flaw in the law when it comes to eligibility requirements, it states that a signed Physician Return to Work & Voucher Report must be received before a voucher can be issued. Well, no one told the doctors to do it, there is no money paid to the doctors and they are simply not doing it. I have seen the number of doctors complying going up but not enough to make a difference. This is the biggest reason I see keeping injured workers from getting their share of the $120Million... I see it all day long, every day.

I do not think there is any rule that states a claims adjuster is supposed to initiate a voucher when the IW cannot return to work. It should be automatic, and why not just make it a little bit easier and provide both vouchers at the same time? What the heck! Who makes these rules?

Also, the extra monies left over should be paid out to those who have significant injuries, and they can try to do this by PD ratings. They should not give the same amount to a person who was able to return to another lob the following month as the person who is on SSDI and preeminently disabled. Again, who made these rules?
