It is stunning to me how partisan the issue of copying records has become. I never would have dreamed it when I started in WC over 20 years ago. It shows how much of a business WC has become. Look no further than the final statement by Mr. Mora. Despite saying he talked to both sides, he portrays AAs as the good guys and defense as the bad. This broad-brush labeling is inaccurate and serves only to divide. If we cannot work together on something as basic as copying records, I'm afraid the WC system is doomed to stay contentious and ineffective, unfortunately at the expense of the ones it is supposed to serve - injured workers and employers.

It is most interesting that a copy service in Modesto, CA charges $86.02 to copy 66 pages from a doctor's office, while a firm in the larger LA area charges over $200.00 for the same service. Did the sixe of the copy service make the difference?

$86.00 for record? Is that a defense firm? Do they have a contrat where they are getting volume. As you know, when it comes to discounts, volume gets you discounts. Also, if they are defense, they don't need to hire collections departments to go after payment. Lien reps. Pay for liens. etc., etc., etc. So there isn't much info there to say that $86.00 is what should be a fair fee.

Well there really was a massive abuse by the A/A copy shops. Nobody can honestly dispute that. They milked it too much and got completely shut down. This is their own doing. I am just surprised and disappointed that it took so long.
I feel bad for those that lose their jobs...but you picked a job that was based on unsustainable abuse that would eventually be stopped.

Agreed, it is well known that in the past, there were AA copy services who were less-than-transparent and approached attorneys to win business in unethical ways. Ideally, the ethical copy services (on either side, defense or AA) will have no problem continuing business, which is good for everyone in the long run if business is awarded to those who are following the law, not taking advantage of a lack of policing.

Never fear there is always a good side. Now AA have a due process issue to list the claims adjuster as a witness - let the litigation begin - The claims adjuster can say that they already sent records to AA. Now they can testify under penalty of perjury on that issue and all issues relating to 8 CCR 10109 -
