The Litigation Support Specialist reviews and assigns workers’ compensation cases to both inside and outside counsel based upon location, case complexity, special instructions and attorney/firm capacity.
Requests for attorney assignment of litigated workers’ compensation claims are received via Outlook, segregated by jurisdiction. The Litigation Support Specialist reviews each request to determine whether assigning a defense attorney is appropriate given the circumstances of the claim. Some requests may be sent back recommending no assignment until the claim is further along. If appropriate, the referral must be evaluated to determine whether appropriate for an in-house or external firm based on state jurisdiction. Claims of policyholders with dedicated attorneys must be identified and assigned as appropriate. The pace of referrals to defense attorneys must be managed pursuant to instructions that change regularly. For California cases, the Specialist must determine which of the 24 district offices of the WCAB is appropriate for venue and determine if the requested firm is on the legal panel for the identified venue.
  • Ensure that all hearings and depositions are assigned to counsel.
  • Maintain panelists and multiple excel spreadsheets to track referrals and special handling instructions.
  • Update contacts and notepads in claims and legal case management systems.
  • Evaluate referrals to determine whether an assignment is necessary.
  • Significant, daily contact with claims professionals, in-house legal staff, court clerks, and law office representatives by phone and e-mail.
  • Works independently without error under time pressure to complete referrals within 24 hours.


  • EDUCATION/EXPERIENCE: Bachelor's degree from an accredited college or university required. Paralegal certificate or equivalent preferred. Minimum of three years experience working in law office or insurance company in the area of workers’ compensation.
  • LANGUAGE ABILITY: Ability to read, analyze, and interpret general business periodicals, professional journals, technical manuals, financial statements or governmental regulations; Ability to negotiate, write and interpret business correspondence; Ability to effectively present information and respond to questions of interdepartmental leaders/partners.
  • REASONING ABILITY: Ability to solve practical problems and deal with a variety of concrete variables in situations where only limited standardization exists; Ability to interpret a variety of instructions furnished in written, oral, diagram, or schedule form.
  • COMPUTER SKILLS: To perform this job successfully, an individual should be highly proficient with the MS Office Suite products and be proficient on applicable databases, systems and vendor software programs.
