Colorado regulators anticipate updating the workers’ compensation medical fee schedule and medical treatment guidelines next year, as well as revising penalties assessed to employers for improperly misclassifying workers, according to the 2018 regulatory agenda that the Department of Labor and Employment released.
The department said the Division of Workers’ Compensation anticipates that in April it will hold a hearing or adopt rules to update the medical fee schedule and set the surcharge paid by insurers.
The department said the DWC also intends to either adopt updated medical treatment guidelines or hold a hearing on proposed revisions by December 2018.
In May, the department's Division of Unemployment Insurance anticipates holding a hearing on a proposal to adjust fines for employers that intentionally misclassify workers as contractors.
The proposed changes were mentioned in a mandatory report all state agencies are required to prepare outlining regulatory changes that are anticipated for the upcoming year. The agenda identifies stakeholders that could be affected by proposed changes, rule numbers and when the department or its divisions anticipate adopting final rules or holding hearings.
