The problem is that the medical providers commonly do not offer appointments for treatment that are convenient to the employee and employer. The business necessity exception will result in many injured workers getting no treatment or losing their jobs if they do.

This comment is by Joe Arcangelini, paralegal to Mr. Schondel. Is the employer required to prove business necessity? If so, what are the requirements? If not, then couldn't they just assert it arbitrarily? Also I agree with Mr. Nelson's comment: The doctors' offices are unlikely to cooperate with this and if they do, it will likely cause unreasonable delay in provision of treatment.
