Justice delayed is Justice denied. I am sure everyone likes to see 95% of the Reconsideration decisions issuing in 60 days, rather than frequently waiting 1-2 years on “Grant for Study.” I hope 2 Backlog Judges will reduce the problem, although 6 new Judges will also add more appeals to the load. Perhaps 1 Commissioner/Deputy for every 20 WCJs is a better ratio for long-term success. By that analysis, we currently need 11 WCAB Commissioners instead of 7.

Perhaps improved supervision and training of Judicial Officers would result in better reasoned decisions by the Court that would yield less Petition for Reconsiderations being filed by both the Applicant & Defense Bars. The WCAB judicial system has been in a steady decline, which has invited excessive litigation for an administrative law system that is supposed to function expeditiously.
