There is a reason why the language in the statute says "contested claim" and not "denied claim." Therefore, I disagree that medical legal can not occur until the claim is denied.

a delayed case is a "contested case"

A delayed case is undetermined and is not "contested" as liability is neither accepted or denied. I'd love to test the issue at the Board.

We issue the EOR's and file the Petitions. Most are getting set aside. We are finally on calendar next month. I can't wait to go heads up on this matter.
