This will need to be addressed during the 2023 legislative session.
Designated Doctors are not equipped to collect taxes. This will be an issue that could drive additional designated doctors away.
One would hope that the Texas Department of Insurance's Division of Workers' Compensation (DWC) will make a legislative recommendation to have the Texas Legislature fix this very bad decision by the Texas Comptroller.
In the meantime, DWC needs to put out guidance on how to report the payment of taxes via EDI. DWC also needs to provide insurers and their vendors how to handle designated doctor bills that do not include the tax for the purpose of the EDI reporting.
