Report: 'Rust' Producers Argue Exclusivity Bars Claims From Shooting

Attorneys for Alec Baldwin and producers of the movie “Rust” are asking a California judge to find that workers’ compensation exclusivity bars a lawsuit by the script supervisor who says she was hurt during a fatal on-set shooting last year, according to media reports.

Maima Mitchell claims she suffered serious physical trauma, shock and injury to her nervous system when cinematographer Halyna Hutchens was fatally shot in October.

NBC News reports that attorneys for Baldwin and the film’s producers argue that the shooting was a workplace accident and should be covered by New Mexico workers’ compensation law, not through a civil action in Los Angeles.

Mitchell’s attorney, Gloria Allred, reportedly said the complaint should be allowed to proceed and that the defendants are “trying to avoid explaining their conduct before a judge and jury in a court of law.”
