Interestingly, MSAs dollar amounts for drugs should be independent of Medicare pricing. The set-aside is for the cost of health care related to the injury but prior to Medicare backstopping any extra costs. Medicare’s actions only affect MSAs if Medicare’s unilateral action on Rx pricing results in overall lower prices for healthcare outside Medicare.
