We had a case where a bus driver was getting TTD (yes, total) while driving a shuttle bus for a friend's company (supposedly for loan forgiveness). On video and everything. Santa Clara DA refused to take the case because the buses were dissimilar, which legally seemed irrelevant to me. That client stopped referring cases for quite some time and I suspect that is why many insurers don't bother as well. A few bad experiences with the DA's office discourages referrals.

Fraud hurts everyone, especially truly injured workers. The carriers recoup their fraud losses by cutting benefits to those who need them because they cannot go after the assets of the fraudsters. (Bad employers top this list) The system is broken. KJP

Why not prosecute carriers as well as employers who commit most of the fraud anyway?
I know that will never happen unfortunately. With very few exceptions.
Just abolish the system and let civil litigation prevail.
