A San Diego attorney has been suspended from practicing law after not returning calls for six months from a client in a workers’ comp case.
George Garcia Perez received a stayed one-year suspension and a year of conditional probation, with the first 30 days spent on suspension, under a California Supreme Court order last month. His discipline will begin Aug. 9, the Northern California Record reported.
According to a stipulation filed with the California State Bar Court in March, Perez admitted that he received voice messages from a client in a workers’ comp case but failed to respond for about six months, starting in March 2015. The client had been calling for an update on the status of her claim after she opted not to settle at that time because she wanted to continue with her medical treatment. The woman, who was hurt at work in 2013, agreed to settle the case in 2017.
The woman submitted a complaint to the State Bar regarding Perez in October 2017. But according to the State Bar Court document, Perez failed to provide a substantive response to several letters, an email and a voice message from the State Bar asking for a response to the allegations.
His inaction represented a failure to cooperate and participate in a disciplinary investigation, the State Bar Court concluded.
Perez also failed to promptly respond to a client and provide substantive responses and updates in a personal injury case, according to the court document.
