It is extremely important that these cases are being prosecuted. Misclassification of employees remains a significant problem in California. It causes employees to suffer long delays in receiving work comp benefits for clearly compensable work injuries. It also impacts their entitlement to other employment protections like minimum wage, health insurance, FMLA, FEHA, Social Security, SDI, Etc.
However, employers and insurance companies are still not being prosecuted for other types of fraud like inaccurate payroll reports, fraudulent denial of medical treatment, untruthful denial of claims, etc. Those types of fraud drastically impact injured workers.
