I do not have any authority to cite to you but in my experience compensable consequences are not new injuries they are part and parcel to the original injury. The new body part expands the nature and the scope of the injury but it is not a new distinct injury that must meet all the threshold

" compensable consequences" such as an injury during a commute for treatment treatment itself etc. it is "clearer" to me it is probably going to be industrial as far as treatment is concerned. As an example see my WC Index page 171 under " Compensable Consequence"

This is from the DIR website which seems to suggest that the exclusions are only for psyche. I interpret this to mean there is no increase for sex or sleep due to a compensable consequence for post 010113 DOIs. Only psyche has the exclusions. Q Does SB 863 affect ratings for sleep dysfunction

The short answer to your question is the case you describe does not qualify for a claim for psychiatric injury. It requires 6 months of actual work to qualify for a compensable consequence of a psychiatric injury. If time on the books as an employee was counted toward the 6 months the limitation
